PROPERTY SELECT USER REGISTRATION TERMS & CONDITIONS

Welcome to PROPERTY SELECT (the “Website” / “Platform”). By registering an account, clicking “I Accept”, or using our services, you enter into a legally binding agreement with PROPERTY SELECT (“we”, “us”, “our”) governed by the laws of the Republic of South Africa.
IMPORTANT NOTICE: Your attention is specifically drawn to clauses that limit our liability, create risk for you, or result in an acknowledgement of facts. These clauses are highlighted in bold or marked with an exclamation. Please read them carefully before registering.
1. Eligibility and Legal Capacity
By registering, you warrant that you are at least 18 years of age and possess the legal capacity to enter into binding contracts in South Africa.
If you are registering on behalf of a business, company, or close corporation (a juristic person), you warrant that you have the explicit authority to bind that legal entity to these Terms.
- By registering as a Private Seller or Landlord, you warrant and represent that you are the registered owner of the immovable property being listed, or that you have been duly authorised by the registered owner(s) to market the property for sale or lease. You confirm that you possess the full legal capacity and authority to enter into this agreement and that the listing of the property does not infringe upon any third-party rights or contravene any existing mandates, including any exclusive mandates granted to a Property Practitioner.
2. Account Registration and Security
You must provide accurate, current, and complete information during the registration process.
You are solely responsible for maintaining the confidentiality of your account credentials (username and password).
You agree to notify PROPERTY SELECT immediately of any unauthorized use or security breach of your account. We will not be held liable for any loss or damage arising from your failure to secure your login credentials.
3. Protection of Personal Information (POPIA Compliance)
By registering an account, you consent to how we process your personal data:
Collection: We collect data such as your name, contact details, email address, and business details to facilitate listings and connect users.
Purpose: Your data is processed strictly to maintain your account, display your public listings, prevent fraud, and communicate platform updates.
Direct Marketing: We will only send you direct marketing communications if you have explicitly opted in during registration. You can opt out at any absolute time via your account settings or by clicking ‘unsubscribe’.

4. User Conduct and Listing Rules
As a registered user, you agree that you will not post, list, or share any content that:
Is false, misleading, deceptive, or fraudulent (in violation of the CPA).
Infringes on the intellectual property rights of others (copyrights, trademarks, etc.).
Contains hate speech, defamatory material, or promotes unlawful activity.
Constitutes “spam” or unauthorized unsolicited commercial electronic communication.
Enforcement: PROPERTY SELECT reserves the right to review, edit, reject, or immediately delete any listing, and suspend or terminate your account if you breach these conduct rules.
5. Role of PROPERTY SELECT as an Intermediary
PROPERTY SELECT acts purely as a digital classifieds and directory platform connecting advertisers with potential buyers or clients.
PROPERTY SELECT does not own, inspect, verify, or guarantee any of the goods, services, or properties listed by users on the Website.
Any transaction, agreement, or dispute arising between users (buyers and sellers) is strictly between those parties. PROPERTY SELECT is not a party to, nor liable for, any transaction concluded via the platform.
6. Limitation of Liability and Indemnity
PLEASE READ THIS CLAUSE CAREFULLY:
To the maximum extent permitted under South African law (including Section 48 of the CPA), PROPERTY SELECT, its directors, owners and its employees will not be held liable for any direct, indirect, incidental, or consequential loss, damage, or injury arising from your use of the platform, your reliance on user listings, or any technical downtime.
You hereby indemnify PROPERTY SELECT against any claims, losses, or legal costs arising from a breach of these Terms by you, or any content/listings you publish on the Website.
7. Fees and Payments (If Applicable)
Basic registration may be free, but certain premium listing features or subscriptions attract fees.
All fees will be explicitly stated in South African Rand (ZAR) inclusive of Value Added Tax (VAT), where applicable, fulfilling Section 23 of the CPA.
Paid services are non-refundable unless required by law or in the case of a major technical failure on our part.
8. Breach and Termination
We may terminate or suspend your account with immediate effect if you commit a material breach of these Terms, engage in fraudulent behaviour, or bring the platform into disrepute.
You may close your account and terminate this agreement at any time by utilizing the account deletion feature or contacting our support desk.
9. Electronic Communications (ECTA Disclosure)
In terms of Section 43 of the Electronic Communications and Transactions Act 25 of 2002, our mandatory disclosures are as follows:

10. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the South African courts.

As soon as you use or register on this website you acknowledge that you have read, understood and accepted the Terms & Conditions, with specific attention drawn to the limitations of liability and indemnity clauses.
