Terms and Conditions for Property Select

Welcome to Property Select. These Terms and Conditions govern your use of our classifieds platform. By accessing the site or posting a listing, you agree to be bound by these rules in accordance with South African law.
- Electronic Communications and Transactions (ECTA) Disclosures
In terms of Section 43 of the ECTA, users are entitled to the following information:

- Legal Status: Sole Proprietor
- Physical Address: Aberdeen, Eastern Cape

- Acceptance and Eligibility
By using Property Select, you represent that you are at least 18 years of age. In accordance with the Consumer Protection Act (CPA), if you are entering into this agreement on behalf of a juristic person, you warrant that you have the authority to do so.
- User Content and Prohibited Conduct
- Accuracy: You are legally responsible for the content of your listings. Listings must not be misleading, fraudulent, or deceptive (CPA Section 41).
- Prohibited Items: You may not list items that contravene South African law, including but not limited to: unlicensed firearms, prescription medication, stolen property, or protected wildlife species under NEMBA.
- Intellectual Property: You warrant that you own or have the right to use all images and text uploaded and you also confirm you are duly authorised to list the property on your listings.
- Listing Packages, Fees, and Cooling-Off Period
Property Select offers the listing tiers as per website:
- Payment: All prices displayed on the website are inclusive of VAT (where applicable) unless otherwise stated.
- ECTA Cooling-off Period: Under Section 44 of the ECTA, a consumer may be entitled to cancel a transaction within 7 days. However, this does not apply once the service (the listing) has begun with the consumer’s consent before the end of the 7-day period. By publishing your listing, you agree to the immediate start of the service.
- Privacy and Data Protection (POPIA)
We are committed to protecting your personal information as required by the Protection of Personal Information Act (POPIA).
- We collect data (name, contact details, IP addresses) solely to facilitate the platform’s services.
- By using the site, you consent to your contact details being visible to potential buyers for the purpose of the transaction.
- We will not sell your personal data to third parties for marketing purposes without your express “opt-in” consent.
- Limitation of Liability and Indemnity
- Intermediary Status: Property Select is a “service provider” as defined in the ECTA. We do not monitor every listing and are not liable for any illegal content posted by users (Section 77 of ECTA).
- Safe Meeting: Users are urged to exercise caution. Property Select is not liable for any loss, theft, or physical harm resulting from user interactions or transactions.
- No Warranty: To the extent permitted by the CPA, the platform is provided without any express or implied warranties.
- Dispute Resolution
In the event of a dispute between the user and Property Select, we encourage an amicable resolution. If unresolved, the dispute may be referred to the National Consumer Commission (NCC) or the relevant provincial consumer affairs office.
- Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any legal proceedings shall be instituted in the High Court or Magistrate’s Court having jurisdiction over the area where our head office is located.
